Terms and conditions of sale
Effective since: 16 April 2018
1. General
- These General Terms and Conditions (“Terms and Conditions”) govern any and all transactions between you (the “Buyer”) and the European Aerosol Federation aisbl (“FEA”), with registered office at Boulevard du Souverain 165, 1160 Brussels, Belgium, with Belgian business registry (BCE) number: 0422.796.670 (the “Seller”) in relation to the online purchase of publications from the FEA website.
Before placing your order, please read these Terms and Conditions carefully. When you place an order on the website, you acknowledge that you have taken notice of these Terms and Conditions and you unconditionally agree with them and accept them. You equally agree that any other terms and conditions are hereby explicitly excluded.
The version of the Terms and Conditions current at the time you place an order will govern the transaction in relation to those products.
If any clause in these Terms and Conditions should be held invalid or not enforceable, this shall have no effect on the other clauses.
The publications offered via the FEA website are not intended for commercial resale.
2. Ordering Process
When you have found the desired publication, you may click on the button ‘FEA Guidelines’ to reach the order form. Please fill in your data, select the publication(s) to be purchased and select the method of payment. Mandatory fields, including a valid VAT number, are marked with an *. By clicking the ‘Continue’ button you will complete the ordering process. If you selected the bank transfer, an invoice will be sent to you.
3. Contract Conclusion
Ordered publication(s) will only be available after payment reception.
If the Seller has received your payment on its account, you should receive your order within five (5) business days. However, this period is not binding.
4. Delivery Of Goods
Publications are solely sent in electronic format (pdf) at the e-mail address provided during the order.
5. Prices, Taxes And Shipping Costs
The price of products which you order from the FEA website will be the price valid at the time you submit your order. The price is displayed on screen before you submit your order. Prices are shown in Euro and do not include value added tax. You accept that you will be responsible for paying any sales or other taxes, duties and charges levied on products in the country where the products are to be delivered to the extent the Seller has not already invoiced you for these.
6. Payment
We accept VISA, EuroCard / MasterCard and American Express and payment by bank transfer.
7. Cancellation Rights / Returns
The return of an electronic version of the standards is only acceptable to the extent that the client demonstrates that the file is unreadable, and this despite the fact that it has a software that allows him to read files of the same type.
8. Warranty
At the moment of delivery you have to inspect the product(s) very carefully. In the event of damaged, wrongful or incomplete deliveries these shall have to be notified within seven (7) business days after the delivery of the products. Complaints received after this period shall be invalid and inadmissible. Please contact FEA at [email protected] in order to rectify the issue.
9. Liability
FEA shall not be liable for any damage or loss suffered by the Buyer (including any indirect or consequential loss) and in any way related to the purchase of the products, except in the event of gross negligence or wilful default on behalf of FEA. FEA shall not be responsible for damage or loss resulting from force majeure circumstances beyond its reasonable control, including, but not limited to, strikes, fire, and interruption in the communication systems, etc. or not obtaining the products from its suppliers or third parties in a timely manner. In any event, FEA’s liability shall not exceed the amount paid for the product, subject of the claim.
10. Intellectual Property Rights
The publications that can be ordered on the FEA website as well as the content of the FEA website is protected by copyright, trademark and other intellectual property rights. All proprietary rights in the publications and the content and materials displayed on the FEA website shall at all times remain with FEA, its Members or their respective suppliers (as the case may be). The publications may not be reproduced in whole or in part, transferred by electronic or conventional means, modified, linked to or used for public or commercial purposes without the prior written consent of FEA.
11.Governing Law and Jurisdiction
These Terms and Conditions and contracts formed under them shall be governed by Belgian law. The place of jurisdiction shall be Brussels (Belgium).
